RECOMMENDATION:

Recommendation
That Council adopt Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, No. 3098 which amends Zoning Bylaw, 1992, No. 2050, by changing the zoning designation of the subject parcels illustrated within Schedule A of Amendment Bylaw No. 3098 from RS-1 [Single Family Residential], RD-3 [Two Family/Single Family Residential] and RD-1 [Two Family Residential] to CD No. 155 [Comprehensive Development District No. 155.

EXECUTIVE SUMMARY:

The proposal is for a rezoning of five low-density residential properties to a multifamily residential building with 119 units with a proposed FSR of 1.56. The subject properties are currently within the Medium Density Residential Proposed Land Use Designation within the Township's Official Community Plan, with a maximum density of 2.0 FSR.

The Zoning Amendment Bylaw was given first reading on May 15, 2023, second reading on October 16, 2023, and third reading on December 4, 2023. Adoption has been withheld pending the registration of a Section 219 covenant, which has now been registered on title.

BACKGROUND:

The Section 219 Covenant CB1178111 addresses the following items:

* Built to Step Code 3.
* $104,000 contribution to inflow and infiltration reduction.
* 50% of bicycle parking having access to Level 1 outlets (120V).
* Provision of seven e-bikes in bikeshare program.
* Proposed 5 3-bedroom units provided as minimum.
* Maintains the indoor amenity room as flex space accessible by all occupants. The space must not be used for storage of materials, equipment, or other items as a principal use. One of the amenity spaces to be used as a fitness room.
* 12 visitor parking spaces to be provided outside of the security gate.
