RECOMMENDATION:

Recommendation
That Council approve an amendment (Schedule "A") to Development Permit DP000094 (Schedule "B") authorizing a roof top deck on the northerly proposed duplex unit located at 468 Foster Street (PID 008-400-571, Lot 17, Suburban Lot 30, Esquimalt District, Plan 772A) as illustrated on the architectural drawings prepared by Zebra Design, stamped "Received July 10, 2018", and staff be directed to issue the amendment to the permit.

BACKGROUND:

On September 11, 2017, Council approved Development Permit DP000094 (Schedule "B") authorizing the development of a two-unit residential dwelling at 463 Foster Street (PID 008-400-571, Lot 17, Suburban Lot 30, Esquimalt District, Plan 772A). The Permit was subsequently issued on November 29, 2017. The existing Permit only allows a roof top deck on the southerly dwelling unit. The ownership of the parcel has since changed and the new owner would like to add a roof top deck to the northerly dwelling unit. In order to do so an amendment to the original Permit is required. The proposed amendment is described in a letter from the designer (Schedule "D") and illustrated in the drawings attached as Schedule "C".

As can be seen from the proposed changes which are identified by the bubble outline on the drawings (Schedule "C"), the proposed roof top deck is entirely imbedded within the roof structure. Except ...
