SUBJECT:                      Adoption of Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, 2025, No. 3153 - 1209 Lyall Street

 

INFORMATION:

 

The adoption of Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, 2025, No. 3153 for the subject property at 1209 Lyall Street was awaiting the required S.219 Covenant modification to be registered (attached as Appendix B). The modification to the covenant is required to limit hours of operation on the site, and to remove the restriction on customers and retail sales on the site:

 

                     Restricts the operation of liquor lounge or accessory retail to the hours between 11 am and 8 pm;

                     Restricts the hours of operation to 40 hours per week and 5 days per week; and

                     Deleted sections of the original covenant which requires that no customers or retail sales are permitted on the site.

 

Staff confirms that the required amendments to the covenant have been made.

 

RECOMMENDATION:

 

Recommendation

That Council adopt Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, 2025, No. 3153.
