BACKGROUND:
A non-essential piece of infrastructure (aka Arbour) has been built within the road boulevard on the frontage of 945 Garthland Road. The construction of the Arbour was carried out without receiving permission from the Township for the use of the boulevard. See Attachment A - site location, Attachment B - Boulevard Alteration Permit (BAP) application, Attachment C - Council Policy E&PW-02 Guide to Boulevard Modifications, and Attachment D - Photos.
The Arbour particulars are:
* Height varies from 1.52 metres to 1.70 metres
* Sited approximately 9 metres along the lot frontage
* Set back approximately 0.51 metres from back of sidewalk
* The nearest utility infrastructure is a watermain located in the general location of the Arbour
* Entrance to the yard is located directly behind the sidewalk.
A cross section of the road right of way is: road, curb and gutter, sidewalk, grassed boulevard, property line. Behind the Arbour the remaining 1.52 metres has been landscaped with boulders, plants and gravel.
ISSUES:

The Streets and Traffic Regulation Bylaw has a requirement that all structures within the boulevard require Council approval. The Arbour portion of this BAP application meets this definition.
