RECOMMENDATION:

Recommendation
That Council extend the expiry date for Development Permit No. DP000210 from December 18, 2025, to December 18, 2026.

EXECUTIVE SUMMARY:

The applicant wishes to extend the expiry of their Development Permit for one year, given their desired timeline. The applicant has committed to a maintenance schedule for the year as part of the proposal.


BACKGROUND:

The Development Permit was issued on December 18, 2023, and, as per Section 504(1) of the Local Government Act, the permit lapses two years after issuance. The permit can either be extended by Council as per the request, or the applicant must submit a new Development Permit application (the existing permit would lapse and all securities held by the Township would be returned to the applicant).

ANALYSIS:

Staff believes the proposal is reasonable. The applicant is removing the development signage and tree protection to present a cleaner and better maintained appearance at street level and will replace the tree protection once construction activity is set to resume. The applicant's maintenance schedule (within Appendix C) is reasonable.


OPTIONS:

1. That Council extend the permit for one year.

2. That Council request additional information in advance of making a decision on the permit extension.

3. That Council let the permit lapse.
