Recommendation

That Council gives first, second and third readings to the Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw [No. 7], 2018, No. 2944.

Operational Strategy - Review Township policies and bylaws to ensure efficient processes; amend and update as necessary

 

BACKGROUND:

 

As a result of enforcement action taken by staff over the summer months, it was noted that Section 63, Marine Navigation [M-4], was not included in the charge sections of “Schedule D” of the Bylaw Notice Enforcement Bylaw.  Additionally, with changes coming to the Zoning Bylaw to better define allowable moorage in Section 63, it became necessary to update the schedule to allow for enforcement by way of Bylaw Notice. 

 

ISSUES: 

 

1.  Rationale for Selected Option

In order to enable staff to write Bylaw Offence Notices for moorage offences created by the Zoning Bylaw, the pertinent schedule of the Bylaw Notice Enforcement Bylaw must be in alignment with the sections of the root bylaws.

The revised bylaw and schedule will be posted on the website if approved by Council.

 

ALTERNATIVES:

 

1.                     That Council gives first, second and third readings to the Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw [No. 7], 2018, No. 2944.

 

2.                     That Council directs any amendments it considers appropriate to Bylaw No. 2944 prior to giving it first, second and third readings as amended.

 

3.                     That Council refers Bylaw No. 2944 back to staff to further revision.
