RECOMMENDATION:

 

Recommendation

That Council approve an amendment (Schedule “A”) to Development Permit DP000094 (Schedule “B”) authorizing a roof top deck on the northerly proposed duplex unit located at 468 Foster Street (PID 008-400-571, Lot 17, Suburban Lot 30, Esquimalt District, Plan 772A) as illustrated on the architectural drawings prepared by Zebra Design, stamped “Received July 10, 2018”, and staff be directed to issue the amendment to the permit.

BACKGROUND:

 

On September 11, 2017, Council approved Development Permit DP000094 (Schedule “B”) authorizing the development of a two-unit residential dwelling at 463 Foster Street (PID 008-400-571, Lot 17, Suburban Lot 30, Esquimalt District, Plan 772A).  The Permit was subsequently issued on November 29, 2017.  The existing Permit only allows a roof top deck on the southerly dwelling unit.  The ownership of the parcel has since changed and the new owner would like to add a roof top deck to the northerly dwelling unit.  In order to do so an amendment to the original Permit is required.  The proposed amendment is described in a letter from the designer (Schedule “D”) and illustrated in the drawings attached as Schedule “C”.

 

As can be seen from the proposed changes which are identified by the bubble outline on the drawings (Schedule “C”), the proposed roof top deck is entirely imbedded within the roof structure.  Except for the access stairs, the new roof top deck will not be visible from any side, front, or rear view.  This proposed amendment conforms to Development Permit Guideline 20.5 (8) which states:

 

Buildings should be designed to minimize visual intrusion on to the privacy of surrounding homes.  Some overlook of adjoining yards and neighboring decks may be unavoidable; however, additional privacy should be achieved by insetting balconies, decks and patios into the building or screening them with latticework or landscaping.

 

The proposed amendment was reviewed by the Advisory Planning Commission at their July 17, 2018 meeting.  The Commission recommended that the application be forwarded to Council with a recommendation to approve as the proposal is inset from the street and the north elevations and visually will not affect the street.

 

The proposed amendment also corrects a mistake in the original Development Permit by changing the words “single family infill” to “duplex” in the first clause of the Permit.

The proposed roof top patio is imbedded into the roof and provides additional outdoor space for the building occupants while respecting the privacy of the neighbouring properties.

The proposed amendment does not have significant sustainability or environmental implications.

2.                     That Council not approve an amendment (Schedule “A”) to Development Permit DP000094 (Schedule “B”) authorizing a roof top deck on the northerly proposed duplex unit located at 468 Foster Street (PID 008-400-571, Lot 17, Suburban Lot 30, Esquimalt District, Plan 772A) as illustrated on the architectural drawings prepared by Zebra Design, stamped “Received July 10, 2018”, and provide the applicant with reasons for their decision.
