Recommendation

That Council resolves that Amendment Bylaw No. 2926, attached to Staff Report DEV-19-040 as Appendix A, which would amend Zoning Bylaw, 1992, No. 2050 by changing the zoning designation of 838 Admirals Road [PID 005-074-011, Lot 17, Block 7, Section 10, Esquimalt District, Plan 2546 Except that part in Plan VIP86845], shown cross hatched on Schedule ‘A’ of Bylaw No. 2926, from CD No. 75 [Comprehensive Development District No. 75] to CD No. 109 [Comprehensive Development District No. 109], and by changing the zoning designation of 842 Admirals Road [PID 006-324-118, Lot 16, Block 7, Section 10, Esquimalt District, Plan 2546], also shown cross hatched on Schedule ‘A’ of Amendment Bylaw No. 2926, from RD-3 [Single Family/Two Family Residential] to CD No. 109 [Comprehensive Development District No. 109], be adopted.

BACKGROUND:

Purpose of the Application

The applicant is requesting a change in zoning from the current mix of RD-3 [Single Family/Two Family Residential] zone and CD No.75 [Comprehensive Development District No. 75l] to CD No. 109 [Comprehensive Development District No. 109].  This change is required to accommodate the proposed 4 storey, 28 unit, purpose-built rental, multiple family residential building including a 28 space parking garage.

 

Amendment Bylaw No. 2926 was given First and Second Readings on August 20, 2018.  Second Reading was rescinded and the Bylaw was amended and read anew on September 24, 2018 to include the following to the list of permitted commercial uses on the ground floor:

                     Business and Professional Office

                     Personal Service Establishment

                     Restaurant

                     Retail Store

 

A Public Hearing was held and Third Reading was given on November 19, 2018.

 

The applicant has voluntarily registered a Section 219 Covenant against the title of 838 Admirals Road and 842 Admirals Road in favour of the Township of Esquimalt in priority to all financial encumbrances.  The Section 219 Covenant received final registration on April 10, 2019.

 

The conditions at Third Reading were as follows:

                     Lot consolidation of 838 Admirals Road [PID 005-074-011, Lot 17, Block 7, Section 10, Esquimalt District, Plan 2546 Except that part in Plan VIP86845] and 842 Admirals Road [PID 006-324-118, Lot 16, Block 7, Section 10, Esquimalt District, Plan 2546] prior to development as the proposed CD No.109 Zone does not work unless the parcels are consolidated

                     The building to be constructed to include two 3-bedroom dwelling units

                     Provision of one fire hydrant on the corner of Admirals Road and Naden Street

                     Three visitor parking spaces will be provided and remain as illustrated in the parking plan, attached as Appendix C to Staff Report DEV-18-077

                     8 parking stalls to have Level 2 (240V, AC plug with a dedicated 40 amp circuit) electric vehicle charging stations installed

                     Provision of one-year BC Transit bus passes for the Victoria Regional Transit System to all the residents

                     That the parcel is not to be subdivided (to prevent stratification)

 

Staff confirms the final registered Covenant CA7349118 adequately implements all of these conditions.

 

ISSUES: 

 

1.  Rationale for Selected Option

This application is consistent with the Land Use Designation of the subject property and the policy direction contained within the Official Community Plan for Neighbourhood Commercial Mixed-Use developments.  This proposed development is an appropriate location for increased density as it is along the main corridor of Admirals Road and the E&N Rail corridor.  This proposed development is also in close proximity to CFB Esquimalt, one of the major employers in the Township, and will provide increased housing options.  This proposed development will also increase the number of rental units to the Township’s housing supply.  Moreover, both the Design Review Committee and Advisory Planning Commission recommended approval of this application.  The Section 219 Covenant has now been signed and registered against the property title.

4. Sustainability & Environmental Implications

Further to Staff Report DEV-18-077, the applicant has completed the Esquimalt Green Building Checklist, detailing green features that will be considered for inclusion in the development should it be approved.

 

5. Communication & Engagement 

In accordance with post Public Hearing considerations, no further communications or engagements have been provided to Council.

 

ALTERNATIVES:

 

1.  That Council resolves that Amendment Bylaw No. 2926 be adopted.

 

2.  That Council defeats Amendment Bylaw No. 2926.
