That Council approve the Boulevard Alteration Permit for 945 Garthland Road, as set out in Staff Report EPW-17-040.

BACKGROUND:

 

A non-essential piece of infrastructure (aka Arbour) has been built within the road boulevard on the frontage of 945 Garthland Road. The construction of the Arbour was carried out without receiving permission from the Township for the use of the boulevard. See Attachment A - site location, Attachment B - Boulevard Alteration Permit (BAP) application, Attachment C - Council Policy E&PW-02 Guide to Boulevard Modifications, and Attachment D - Photos.

 

The Arbour particulars are:

 

                     Height varies from 1.52 metres to 1.70 metres

                     Sited approximately 9 metres along the lot frontage

                     Set back approximately 0.51 metres from back of sidewalk

                     The nearest utility infrastructure is a watermain located in the general location of the Arbour

                     Entrance to the yard is located directly behind the sidewalk.

 

A cross section of the road right of way is: road, curb and gutter, sidewalk, grassed boulevard, property line. Behind the Arbour the remaining 1.52 metres has been landscaped with boulders, plants and gravel.

 

 

ISSUES: 

 

1.  Rationale for Selected Option

 

The Streets and Traffic Regulation Bylaw has a requirement that all structures within the boulevard require Council approval. The Arbour portion of this BAP application meets this definition. Staff have reviewed the application, set back from sidewalk, location of utilities, sight lines and nature of the structure. Based on this review, staff find this structure as acceptable and recommend that the BAP be approved.

 

2.  Organizational Implications

 

There are no organizational implications to the granting of the BAP.

 

3.  Financial Implications

 

The implementation of the BAP does not impose any significant financial implications on the operational budgets of either Engineering and Public Works or Community Safety Services departments.

 

4.  Sustainability & Environmental Implications

 

There are no sustainability and environmental implications.

 

5.  Communication & Engagement

 

Once approved, the Applicant and Complainant will be informed of the issuing of the BAP and its conditions.
