BACKGROUND:

Appendix A: Housing Agreement Bylaw, 2023, No. 3102.

Appendix B: Map

PURPOSE OF APPLICATION:

The applicant is proposing to construct a Detached Accessory Dwelling Unit (DADU) in the rear yard of the subject property. The Single Family DADU Residential [RS-6] zone that regulates this development permits a DADU conditional on the owner entering into a Housing Agreement and granting a s.219 Covenant with the Township.

CHRONOLOGY:

November 10, 2022 - Application received

February 21, 2023 - Advisory Planning Commission meeting

April 3, 2023 - Council meeting, first three readings

ISSUES:

1.  Rationale for Selected Option

Registration of the Housing Agreement would ensure the proposed DADU on the property is not restricted in its availability for use as rental accommodation, and that the registered owner of the lot occupies either the existing Single-Family Dwelling or the proposed DADU as the owner’s permanent residence.

2.  Organizational Implications

This Request for Decision has no organizational implications.

3.  Financial Implications

This Request for Decision has no financial implications.

4.  Sustainability & Environmental Implications

This Request for Decision has no sustainability or environmental implications.

5.  Communication & Engagement

A Housing Agreement and Section 219 Covenant is required as part of the associated Development Permit application. The Local Government Act does not require that notification be provided when a municipality is considering a Housing Agreement Bylaw.

ALTERNATIVES:

1. That Council adopts Housing Agreement Bylaw, 2023, No. 3102.

2. That Council defeats Housing Agreement Bylaw, 2023, No. 3102 with reasons.
