RECOMMENDATION:

 

Recommendation

That Council amend Development Permit DP000052, as attached as Schedule A to Staff Report DEV-17-040, so that it will expire on July 16, 2018 unless a plan of subdivision is registered in the Land Title Office before that time, and authorize the Director of Development Services to issue an amended permit.

STRATEGIC RELEVANCE:

 

The proposed subdivision supports the strategic priority to “support community growth and development consistent with our Official Community Plan”.

 

 

BACKGROUND:

 

Council approved Development Permit DP000052 on July 13, 2015.  It was subsequently issued on July 16, 2015.  The Development Permit contains a condition that it will lapse in two years from the date of issuance if the holder of the permit does not register a plan of subdivision.  A plan of subdivision has not been registered; therefore, the Development Permit will lapse on July 15, 2017 if the two year date is not amended.  Given that the permit holder is actively trying to sell the property, he has applied to have the Development Permit amended by extending the date before a subdivision plan has to be registered by one year. 

 

ISSUES: 

 

1.  Rationale for Selected Option

 

Extending the date to register a plan of subdivision allows the applicant more time to sell the land and have the new owner register a plan of subdivision for the proposed three-lot subdivision.

 

2.  Organizational Implications

 

Extending the date upon which the Development Permit will lapse has far fewer organizational implications than having the owner go through the whole development permit process again which would be the consequence of letting the current Development Permit lapse.

 

3.  Financial Implications

 

There are no significant financial implications associated with granting a one-year extension to the Development Permit.

 

4.  Sustainability & Environmental Implications

 

There are no significant sustainability and environmental implications associated with granting a one-year extension to the Development Permit.

 

5.  Communication & Engagement

 

There are no community engagement requirements associated with granting a one-year extension to the Development Permit.

 

ALTERNATIVES:

 

1.                     That Council amend Development Permit DP000052, as attached as Schedule A to Staff Report DEV-17-040, so that it will expire on July 16, 2018 unless a plan of subdivision is registered in the Land Title Office before that time, and authorize the Director of Development Services to issue an amended permit.
