STRATEGIC RELEVANCE:

BACKGROUND:
Appendix A: Amendment Bylaw No. 3099
Appendix B: Amendment Bylaw No. 3100
Appendix C: Covenant release (1076 Colville)
Appendix D: Covenant release (1072 Colville)
CHRONOLOGY:
• 2019 - Rezoning application submitted to change from RS-6 to CD-128 and CD-129 to allow for the construction of a Two-Family dwelling
• 2021 - Section 219 Covenant prohibiting suites is registered
• 2021 - Rezoning completed
• August 2022 - Current Rezoning application submitted
• October 18, 2022 - Advisory Planning Commission
• February, 2023 - Revised plans submitted
• March 20, 2023 - Council meeting, Public Hearing waived
• May 1, 2023 - Council meeting, first three readings and staff authorized to remove the S. 219 covenant prohibiting suites
• May 4, 2023 - S. 219 covenant released from title
ISSUES:
1. Rationale for Selected Option
Given that the addition of a suite for each previously approved duplex unit (four suites in total) represents a relatively minor increase in gross density, and that there is a severe shortage of housing in Esquimalt, staff recommend that this application be approved.
2. Organizational Implications
This Request for Decision has no organizational implications.
3. Financial Implications
This Request for Decision has no financial implications.
4. Sustainability & Environmental Implications
The proposal before Council would result in a denser urban environment which is generally associated with reduced greenhouse gas emissions. The livability of a development and the neighbourhood contributes to the social and economic sustainability of the community. The applicant has also submitted a Green Building checklist.
5. Communication & Engagement
At the regular meeting of Council on March 20, 2023, Council decided to not hold a Public Hearing on the proposed Zoning Bylaw Amendment, as per S.467 of the Local Government Act. A notice indicating the date of the first reading of the Zoning Bylaw Amendment was mailed to tenants and owners of properties within 100 metres (328 feet) of the subject property, and notice was placed in two editions of the Victoria News. Signs indicating that the properties are under consideration for a change in zoning are placed on the Colville Road frontage and were updated to reflect that a Public Hearing was not held.
ALTERNATIVES:
1. That Council adopt Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, 2023, No. 3099 [Appendix A] and Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, 2023, No. 3100 [Appendix B].
2. That Council defeat Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, 2023, No. 3099 [Appendix A] and Zoning Bylaw, 1992, No. 2050, Amendment Bylaw, 2023, No. 3100 [Appendix B].
