SUBJECT:                      Proposed Amendments to Bylaw Notice Enforcement Bylaw

 

INFORMATION:

 

In May 2024 Council adopted amendments to the Maintenance of Property and Nuisance Regulation Bylaw, 2014, No. 2826 to restrict permitted hours for construction activities within the Township of Esquimalt.

 

These amendments also required a change to Schedule M of the Bylaw Notice Enforcement Bylaw, 2014, No. 2839 to incorporate penalties for contraventions to the hours for permitted construction activities and to renumber the associated bylaw section numbers as a result of the amendments introduced in Spring. Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw, 2024, No. 3146 (Attachment 1) proposes to replace Schedule M to resolve the discrepancies between the two bylaws. The proposed changes to Schedule M are highlighted in Attachment 2.

 

Council is requested to consider giving three readings to Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw, 2024, No. 3146 to bring the Bylaw Notice Enforcement Bylaw into alignment with the newly enacted provisions for construction noise in Bylaw No. 2826.

 

Should Council opt to provide bylaw readings for the proposed amendments, the following motions would be appropriate:

 

That Council give first reading to Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw, 2024, No. 3146.

 

That Council give second reading to Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw, 2024, No. 3146.

 

That Council give third reading to Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw, 2024, No. 3146.

 

Alternatively, if Council does not wish to make any further amendments to proposed Bylaw No. 3146, Council could give three readings with the following motion:

 

That Council give three readings to Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw, 2024, No. 3146. 

 

If Council gives three readings to Bylaw Notice Enforcement Bylaw, 2014, No. 2839, Amendment Bylaw, 2024, No. 3146, final reading and adoption will occur at the next Council meeting scheduled to be held on September 23, 2024.
